At UpScale Solutions Pty Ltd (ABN 48 679 244 592), we value your privacy. This policy explains how we collect, use, disclose and protect your personal information in Australia, including when we provide AI, analytics and custom software services.

We aim to handle personal information in line with the Australian Privacy Principles where reasonably practicable.

1. What this policy covers

This policy applies to personal information we collect about:

  • visitors to our websites and digital channels

  • prospective and current clients and their staff

  • people who sign up for consultations, events, content or marketing

  • job applicants and contractors.


Client systems and service delivery
When we build, host or support custom software and AI solutions for a client, we may handle personal information within that client’s systems. In these situations, the client is usually responsible for deciding how personal information is collected and used (often called the “controller”), and we generally act as a service provider processing information on the client’s instructions and under our contract with them.

2. The information we collect

The types of personal information we may collect include:

  • Contact details: name, job title, company name, email address, phone number.

  • Business information: organisation size, industry, systems used and other details you choose to share about your operations.

  • Service information: information and data you provide so we can analyse, design, build or support software and AI solutions for you (which may include information about your customers, staff or suppliers).

  • Usage and technical data: IP address, device type, browser, pages visited, time spent, and interactions with our content, collected through cookies and similar technologies.

  • Recruitment information: CVs, cover letters and other information you provide when applying for roles.

We do not usually seek to collect sensitive information (such as health information) and will only do so with your consent or where required or authorised by law.

3. How we collect information

We may collect personal information:

  • directly from you, for example when you complete a form, book a consultation, download content, talk with us, or send us an email

  • from your use of our websites, products and services (including cookies and analytics tools)

  • from publicly available sources such as LinkedIn and company websites

  • from third parties where you have authorised them to share information with us.

You can choose not to provide certain information, but this may limit our ability to provide some services to you.

4. How we use your information

We may use your personal information to:

  • respond to enquiries and provide consultations, proposals and services

  • assess whether your organisation is a good fit for a free custom AI solution roadmap or other offers

  • deliver, configure and support our software and AI solutions

  • analyse and improve our services, website performance and user experience

  • personalise content and communications that may be relevant to your role

  • manage our relationship with you, including billing and administration

  • comply with legal obligations and manage risk, fraud and security.


We do not sell your personal information.

5. Direct marketing

We may send you emails with insights, case studies, event invitations and offers about AI, analytics and custom software that we think may interest you in your professional role.

You can opt out of marketing at any time by using the unsubscribe link in our emails or by contacting us using the details below. We will still send you essential service and account communications.

6. Cookies and analytics

Our websites may use cookies and similar technologies to:

  • remember your preferences

  • understand how our sites are used

  • improve content, performance and security

  • support online advertising and retargeting.

You can control cookies through your browser settings. If you disable cookies, some features of our websites may not work as intended.

We may use analytics and advertising tools provided by third parties (for example Google, LinkedIn or Meta), which may process your usage data in accordance with their own privacy policies.

7. AI, automation and data used for modelling

Because we provide AI and automation services:

  • We may use data you supply (or that we generate in the course of providing services) to design, train, test and monitor AI models and automations for you, in line with our contractual arrangements.

  • Where possible, we aim to de-identify or aggregate data used for internal testing, benchmarking and product improvement.

  • We may use third-party AI platforms and infrastructure providers. When we do, we take reasonable steps to ensure appropriate contractual and security protections are in place.

  • We do not rely solely on automated decision-making for any decisions that have significant legal or similar effects on individuals without providing appropriate human review by or through our clients.

If we work with you as a service provider, our detailed data processing obligations will usually be set out in a separate contract.

Data used for AI in client solutions
Any use of data to design, train, test or monitor AI models and automations is generally done for the client’s solution and under our contractual arrangements and instructions. Where we use data for internal testing, benchmarking or service improvement, we aim to use de-identified or aggregated data where reasonably practicable.

8. When we share your information

We may share personal information with:

  • our staff, contractors and trusted service providers who help us operate our business and deliver services (for example cloud hosting, CRM, analytics, email and document management providers)

  • professional advisers such as lawyers, accountants and insurers

  • third parties when you ask us to or where it is reasonably necessary to provide our services

  • regulators, government authorities or law enforcement where required or authorised by law.

Some of our service providers may be located, or may store data, outside Australia. Where we disclose personal information overseas, we take reasonable steps to ensure that the recipient will handle it in a way that is consistent with this policy and applicable privacy laws. The above excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

9. Data security

We take reasonable physical, technical and organisational measures to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure.

These measures include access controls, encryption or pseudonymisation where appropriate, secure development and deployment practices, staff training and regular review of our security settings.

However, no method of transmission or storage is completely secure, so we cannot guarantee absolute security.

10. Data retention

We keep personal information only for as long as it is reasonably necessary for the purposes described in this policy, or as required by law.

When personal information is no longer needed, we will take reasonable steps to de-identify or securely destroy it.

11. Accessing and correcting your information

You may request access to the personal information we hold about you, or ask us to correct it if it is inaccurate, out-of-date, incomplete, irrelevant or misleading.

We will respond to your request within a reasonable time and may ask you to verify your identity. In some cases, we may need to refuse a request (for example, where disclosure would impact the privacy of others or breach legal obligations), but we will explain why if this occurs.

Requests relating to client systems
If your request relates to personal information held in a system we provide to one of our clients, the client will usually be the best first contact for access, correction or deletion requests. Where appropriate, we will support our client to respond in line with our contract and applicable law.

12. Complaints

If you have concerns about how we have handled your personal information, please contact us using the details below and tell us what has happened. We will investigate your complaint and respond within a reasonable time.

If you are not satisfied with our response, you may lodge a complaint with the Office of the Australian Information Commissioner (OAIC) via their website or by using the contact details available on that site.

13. Changes to this policy

We may update this Privacy Policy from time to time. The updated version will be posted on our website with a new effective date. We encourage you to check back periodically.

Mobile terms of service

The UpScale Solutions mobile message service (the "Service") is operated by UpScale Solutions (“UpScale Solutions”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to UpScale Solutions’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of UpScale Solutions through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers.

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with UpScale Solutions. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to [insert your sending number] or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other UpScale Solutions mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received, and we will not be responsible for honouring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
